The cap and invest program is supposed to give this difficult transition, but it has gone astray. Biofuel is not a clean energy solution.

Cap and Invest and the Low Carbon Fuel Standard (LCFS) funneled nearly $28 billion to oil companies and biofuel suppliers from 2013 to 2024, according to a new report from The Climate Center (https://theclimatecenter.org/fossil-fuels/clearing-the-zero-emission-path/). These two programs, often referred to as the state's "signature" climate programs, are designed to make carbon emitters pay for their pollution. Instead, key design choices have created billions of dollars in subsidies for oil and gas companies to take advantage of. The combined value of free Cap and Invest allowances given to oil refiners and drillers and LCFS credits awarded to oil companies and other biofuel suppliers totaled roughly $27.8 billion. The flaws in these programs incentivized continued reliance on combustion fuels, delaying the necessary transition to zero-emission vehicles and public transit. Climate policies that subsidize and fund combustion fuels are not smart climate policies. Over the same time period, $27.8 billion could have instead funded the installation of 2.8 million level-two EV chargers to serve roughly 11 million Californians, free public transit statewide for 12 years with $11 billion left for service improvements and transit electrification, or complete job transition support for California's oil workers, with some $15 billion left over. I urge you to take the following steps to reform these carbon trading programs: - Stop issuing free Cap and Invest allowances to oil refiners and drillers; - Rapidly phase out issuing LCFS credits to producers and suppliers of combustion fuels that compete with the electrification of transportation. It's time to reorient California's climate policy to prioritize the state's decarbonization goals. Thank you for your leadership and service to California's climate future.

I strongly oppose the proposed 2026 amendments to the Cap-and-Invest (formerly Cap-and-Trade) program. These changes will raise costs — both directly and indirectly — on Central Valley families, farms, and small businesses while delivering zero meaningful benefit to California's climate or environment.
The core problem is the accelerated tightening of the allowance cap: the removal of approximately 118 million allowances from the 2027–2030 budgets plus a much steeper decline trajectory after 2030 to reach an 85% reduction by 2045. This will drive carbon allowance prices sharply higher. Covered entities (fuel distributors, utilities, refineries) will simply pass those costs on to all of us through higher gasoline, diesel, electricity, and natural-gas prices.
For Central Valley agriculture — our largest industry — the impact will be devastating. Diesel powers tractors, harvesters, and the trucks that move our produce. Electricity and natural gas run irrigation pumps, dairy operations, and food-processing plants. Small businesses that support farms (equipment dealers, trucking companies, processors) will face the same increases. Rural families already stretched thin will pay more to commute, heat their homes, and buy groceries. CARB's own Standardized Regulatory Impact Assessment admits these costs are passed through to individuals and businesses and will produce small but real negative effects on jobs and output in food processing.
The changes to offsets (capping them at 6% and requiring one-for-one allowance retirement) make the problem worse. Dairy digesters and healthy-soils projects — major offset generators right here in the San Joaquin Valley — will lose revenue, removing an important income stream that actually helps farmers reduce emissions voluntarily.
California's entire approach is performative and symbolic. Our state emits roughly 360 million metric tons of CO₂e per year — less than 1% of global emissions. Even if we drove our emissions to zero tomorrow, global emissions would barely change because China, India, and other countries continue to build coal plants and increase output. We are lowering the standard of living for Californians — especially in the Central Valley — for no measurable climate benefit. This is not serious environmental policy; it is virtue-signaling that punishes working families and farms while the rest of the world ignores the problem.
Instead of layering on more costly regulations, CARB and the Legislature should immediately reduce regulatory and compliance burdens. Slow or freeze the cap decline, protect agricultural offset programs, expand the Allowance Price Containment Reserve to prevent price spikes, and dedicate auction revenue to direct rebates for agricultural diesel and rural energy costs. At the same time, California should roll back the anti-oil policies that have driven thousands of high-paying jobs out of Kern County and other parts of the Central Valley. Bringing back oil production would create good local jobs, increase state revenue, and help keep fuel prices lower for everyone — exactly the opposite of what these amendments will do.
I urge the Board to reject these amendments as proposed. Do not adopt them on May 28. California does not need to make life more expensive for its own citizens in the name of symbolic global leadership. Focus on real, cost-effective solutions that protect our farms, small businesses, and families instead of punishing them.

As you may know, BizFed is a massive grassroots alli...↓ance that unites chambers of commerce, trade associations, minority business groups, economic development organizations, business improvement districts, and other business groups to advocate for policies and projects that strengthen the regional economy. We have more than 240,000 members, represent 420,000 employers, and 5 million employees.

BizFed has, for quite some time, supported an "all of the above" energy policy, which we believe is essential to keep California competitive in a volatile global economy.

BizFed members have consistently voiced serious concerns about the state's high taxes and regulations through our Pulse Poll. Based on publicly available information about the Cap and Invest regulations, consumers, including businesses, will bear the majority of these costs. Additionally, California businesses already face high fuel prices. This measure could likely reduce refining capacity and increase supply vulnerabilities, making it more expensive to do business in California.

At a time when affordability remains the main concern for Californians, including businesses of all sizes, knowingly promoting a policy that raises fuel costs and worsens supply volatility is deeply troubling.

Californians already face some of the highest gasoline prices in the United States, and recent refinery closures in California make this situation more worrying. Our regional economy relies on the stability of local refineries. Any new compliance costs threaten the viability of the remaining facilities, risking more than 500,000 industry-supported jobs and the tax bases of harbor communities in both Southern and Northern California.

We are proud to live in California. Businesses across the state, including but not limited to BizFed's members, support the state's commitment to environmental stewardship. We continue to be cognizant on the impacts of how energy policies can affect middle- and working-class families and jobs.
